On this day in Henry County history, May 7, 1896, the New Castle Courier reported Abraham Wrightsman had retired as justice of the peace in Mooreland after 30 years. "He leaves an irreproachable record," the newspaper article said.JUSTICE OF THE PEACE HISTORY IN INDIANAFrom the earliest settlement of the state, justices of the peace (JPs) were constitutional officers who served five-year terms as part-time magistrates. Each township in Indiana elected a JP, who did not have to be a lawyer. Justices’ courts were designed to be easily accessible to every citizen, who could bring a claim without an attorney. JPs had countywide jurisdiction over marriages, petty crimes, civil cases involving real and personal property of small value, and, later, traffic violations. A justice also could issue “peace bonds,” similar to a temporary restraining order. Township constables worked in tandem with JPs to serve summonses and enforce court orders.By 1939, the Marion County JP courts were so heavily used that two countywide common pleas courts were added to handle traffic and misdemeanor cases. In the 1950s, however, there were several attempts to reform or abolish the JP courts due to money scandals and the outdated nature of the system.The General Assembly enacted legislation calling for statewide changes in the JP system in 1957 and 1959, but both laws were found unconstitutional. In response, Marion County common pleas, municipal, and criminal courts simply assumed more and more responsibilities previously exercised by JPs, leaving the justices primarily responsible only for marriages by the 1960s.A 1970 statewide referendum removed JPs as constitutional officials and led to a 1975 state law that abolished all JP courts. In Marion County only, township small claims courts supervised by the circuit court replaced justice of the peace courts in every jurisdiction except Franklin Township, where voters rejected the change. Commonly referred to as “people’s courts,” small claims courts function much like the earlier JP courts and deal mainly with landlord-tenant disputes, unpaid bills, and property damage amounting to less than $1,500.BASKETBALL LIVES HEREThis Day In Henry County history is brought to you by Destination Henry County Indiana. On this day in Henry County history, May 5, 1899, a fire destroyed the highly regarded Bundy Hotel.The photo here, courtesy Doug Magers, shows what was left of the grand hotel with the Henry County Courthouse in the background. The hotel was located at the corner of Main and Race streets. The New Castle Courier reported the tragic event this way:"The citizens of New Castle were called out about 3 o'clock last Friday morning to witness the most disastrous fire that has ever visited this city. When first discovered, the fire was burning in the roof of the Bundy House livery stable owned and operated by Charles Bundy."The great heat from the burning barn soon endangered other property and a light breeze from the north carried the flames across the alley, briefly setting fire to the fine residence of Judge Mellett."The wind soon veered to the west....and all the time the fire was progressing toward the Bundy House, owned by Frank Bundy. A bucket brigade had been organized and the roof of the rear of the hotel protected as much as possible, but soon the cornice took fire and despite the efforts of the fire company, the flames spread rapidly over the building."Coming as it did from the rear and roof of the building, the guests in the house, of which there were many, all escaped without injury."The scene was a very exciting one as the guests crowded into the street and mingled with the throng of citizens who stood helplessly by and watched the destruction of one of the finest buildings and best businesses in the city."Probably no fire in this city ever caused more universal regret than the destruction of this property. The Bundy boys, after years of hard labor, had built up a business of which they might be proud and which was a great benefit to the town, and its destruction is not only a financial calamity to them, but a serious loss to the community.Within less than a year, the Bundy Hotel was stored by the Bundy brothers. Over the years, several additions and modifications were made to the hotel. However it was demolished in the mid-20th century following the demise of the final Bundy to own the property, Nellie Bundy Bailey. On this date in Henry County history, May 5, 1986, Helen Magner, Henry County’s best-known artist, died at the age of 98. Helen grew up in Sioux City, Iowa and later attended the Chicago Academy of Fine Arts as well as the Chicago Institute. She taught in rural schools and later at Henry Kendall College in Tulsa, Okla.For many years she lived in New Castle and had a studio in the home of Miss Helen Goodwin, a famed local painter. Helen once illustrated a book of children's poems and had a number of her own poems published while living here.Some may still remember her popular newspaper column, "Pencil Sketches," published weekly in The Courier-Times in which she reported on what art was being shown, where it was on display as well as the background of the artist.Do you have a favorite Helen Magner art piece? On May 4, 1883, the Jerry Mason Grand Army of the Republic Post No. 168 was instituted at Knightstown.Mason was a lieutenant who was killed in the battle of Chickamauga, Ga. on Sept. 20, 1863. He was the first Wayne Township casualty of the Civil War. Here's a photo of Mason and a painting of the battlefield.The Battle of Chickamauga, fought on September 19–20, 1863, marked the end of a Union offensive in southeastern Tennessee and northwestern Georgia. It was the first major battle of the war fought in Georgia, the most significant Union defeat in the Western Theater and involved the second-highest number of casualties after the Battle of Gettysburg. Mason and New Castle's Orlistus Powell were two of 4,000 soldiers killed in action those two days. Another 25,000 were wounded.In Hazzard's History of Henry County (where this photo originated) it says the following about Mason:Lieutenant Jerome Bonaparte Mason, son of Daniel and Nellie Mason, wasborn in the year 1837, Knightstown. Indiana, but the exact date of his birthis not now obtainable.He was a brave, intrepid soldier and the first commissioned officer fromKnightstown and Wayne Township killed in the Civil War. Because of thisfact and to do honor to his name, the G. A. R. Post at Knightstown was namedthe "Jerry B. Mason Post," "Jerry" being the name by which he was familiarlyknown, but his correct name was as it appears at the beginning of this sketch.He was instantly killed at the famous battle of Chickamauga, Georgia, on Sun-day afternoon, September 20, 1863,, at which time, being attached to the staff ofGeneral Walter C Whitaker, who commanded the brigade, he was in the act ofcarrying a message from the latter's headquarters to the headquarters of thedivision commander, when he was struck in the forehead by a shell. When at home on furlough a short time before this tragic ending of his life, he told his wife and two or three of his friends a dream he had and at its conclusion stated in bidding them goodbye, "I will never see you again." The vision showed him with particularity the scene of the battle, what he wasdoing at. the time and how he would be killed, and curiously enough was inaccordance with the facts as they afterwards transpired.From boyhood. Mason was interested in military affairs and in 1861 organizeda company of zouaves, than which there was no better drilled military organiza-tion in the State.His sword was saved from the battlefield and given into the possession of hiswidow who died some years ago at Kansas City, Missouri. His wife was adaughter of Dr. Hill who, at the beginning of the Civil War, was a residentof Knightstown. The Post at Knightstown is the owner of an excellent portrait of Lieutenant Mason, whose remains are laid in the National Cemetery at Chattanooga, Tennessee, havingbeen removed there from the battlefield when the National Cemetery was established.
